Website and valuation services
Last updated 23 October 2026
Quantum Valuation ABN 40 259 337 618. These terms cover use of our website, www.quantumvaluation.com, and the valuation services we agree to provide. References to "we", "us" and "our" mean Quantum Valuation. References to "you" mean the person or organisation using the website or engaging us.
The website provisions apply when you use our website. For valuation work, we will provide or link these terms with our quote or engagement letter for your acceptance. An engagement begins when we confirm your instructions in writing. An enquiry alone does not engage us or oblige you to pay a fee.
If we agree specific engagement terms with you, those terms take priority where there is an inconsistency. The report records the agreed scope, assumptions and limitations. It does not add new contractual exclusions unless separately agreed. Applicable law, court orders and expert witness duties take priority over these terms.
We provide independent property valuations for the purpose, property, valuation date and intended users agreed in writing. Our fee pays for professional work and is not dependent on achieving a particular value or outcome. We may decline instructions where we lack appropriate expertise, have a conflict of interest or cannot act independently.
A valuation is a professional opinion at a specified date, subject to the agreed scope and disclosed assumptions. It does not guarantee a sale price, lending approval, tax treatment, court outcome or acceptance by a government agency. Unless expressly included, our services do not include legal, tax, financial, building, engineering or environmental advice.
You must identify the client, valuation purpose, relevant date, intended users and any deadline before we accept the engagement. Tell us about material matters you know of, including title restrictions, approvals, leases, disputes, environmental issues and changes to the property.
You must take reasonable care to provide accurate, complete information and arrange lawful, safe access where an inspection is required. If instructing us for another person or organisation, you must have authority to do so and identify who is responsible for payment. We will identify material verification limits and assumptions in our report and exercise reasonable professional care when relying on supplied information.
The accepted quote or engagement letter sets out our fees, GST, approved expenses and payment arrangements. Any price displayed for consumers will include GST and unavoidable charges. We will obtain your agreement before charging for additional work or expenses outside the agreed scope.
Unless otherwise agreed in writing, payment is required before release of the final report. We may begin work without an upfront payment. Fees become payable for work properly performed even if the assessed value differs from your expectations, subject to your statutory rights. Payment does not transfer ownership of our underlying intellectual property.
We will confirm any agreed delivery date. Other turnaround statements are estimates dependent on access, information and the complexity of the assignment. Tell us before engaging us if a deadline is essential. If a delay arises, we will notify you promptly and discuss a revised timeframe and available options.
A change in purpose, valuation date, property information, intended users or required work may require a revised scope and fee, agreed before the additional work starts. Court attendance, conferences, supplementary reports and responses beyond the agreed scope are separately quoted.
You may cancel by notifying us in writing. Unless your statutory rights require otherwise, you pay only a reasonable amount for work properly performed up to cancellation and authorised, non-recoverable third-party costs. This will not exceed the agreed total fee unless you approved additional work. We will provide a breakdown and refund any payment exceeding the amount properly due.
We may suspend work for overdue payment, missing essential information or unsafe access, after reasonable notice and an opportunity to resolve the issue where practicable. We may end an engagement if it cannot lawfully or professionally continue. We will explain the reason where permitted, account for work completed and refund unearned payments. Your statutory cancellation and refund rights remain unaffected.
The extent of inspection and research will be agreed for each assignment. A valuation inspection is not a building or pest inspection and does not establish structural condition, compliance, contamination status or the absence of concealed defects.
We will state significant assumptions and limitations, including any reliance on plans, supplied measurements, historical information, title or planning information. A retrospective valuation assesses conditions at the nominated historical date using available evidence. Notify us promptly if you identify a material factual error or information that may affect the assessment.
Only the client and other intended users expressly identified in the engagement or final report may rely on it, and only for the stated purpose and valuation date. A report must be read as a whole with its assumptions and limitations. Drafts, informal discussions and preliminary figures are not final valuations and must not be relied on as such.
You may provide the complete final report to your professional advisers and to a court, tax authority or other recipient where this is necessary for its agreed purpose or required by law. Providing it does not, by itself, authorise reliance for another purpose or by another person. Any broader reliance requires our prior written agreement, subject to mandatory law.
Do not alter a report, remove qualifications, attribute edited content to us, or repurpose it for another property, date or transaction. Obtain our written consent before publishing or using extracts in advertising, an investment offer or a public document, unless disclosure is legally required.
Where we act as an expert witness, our overriding duty is to assist the court impartially. Neither payment nor these terms permits a client to direct our opinion or prevent compliance with court rules, orders or professional duties. Joint appointments, access to communications and release of reports are subject to the applicable court requirements and engagement arrangements.
We retain intellectual property in our website content, report templates, methodologies and original work, subject to third-party rights. Once the agreed fees are paid, you receive a non-exclusive licence to use the final report for its agreed purpose, including the disclosures permitted above. This does not restrict rights that arise under mandatory law or court requirements.
You retain ownership of material you supply and permit us to use it as reasonably necessary to perform the engagement, maintain professional records and meet legal obligations. You must have authority to supply that material.
Website articles, calculators, indicative figures and other general content are for information only. They are not a property-specific valuation or personal legal, tax or financial advice. Obtain advice appropriate to your circumstances before acting.
You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code or submit unlawful material. If account facilities are available, keep your credentials secure and notify us of suspected misuse. We may restrict access reasonably necessary to address misuse or a security issue. External websites and payment services have their own terms; we do not control their content or operation.
We handle personal information in accordance with applicable privacy law and any privacy notice made available on our website. Information supplied for an engagement may be used to perform the work, communicate with you, administer payment and maintain professional records.
We treat non-public client information as confidential. Disclosure may be necessary to service providers assisting with the engagement under appropriate confidentiality and security arrangements, or to professional advisers, insurers, regulators or courts where lawfully required or reasonably necessary. We will take reasonable steps to protect information. These terms do not authorise unrelated marketing or the public use of your report or personal details.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, remedy or other right that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. This includes applicable rights relating to due care and skill, fitness for a disclosed purpose and supply within a reasonable time.
We remain responsible for loss for which we are legally liable. We do not warrant uninterrupted website availability, and are not responsible for loss to the extent caused by unauthorised report use, alterations made by others or inaccurate information we could not reasonably have identified through the agreed professional work. This does not excuse our negligence, breach of contract or failure to meet a mandatory duty. Any allocation of responsibility remains subject to applicable law.
Send questions, factual corrections or complaints to ryan@quantumvaluation.com, identifying the property or engagement and the issue you want reviewed. We will consider the matter fairly and respond within a reasonable time. If unresolved, either party may suggest mediation. You remain free to seek a statutory remedy, contact a relevant regulator or professional body, or commence proceedings, including urgent relief.
We may update these terms by publishing a revised version and its date. Updated website provisions apply prospectively. An existing engagement remains subject to the version accepted when it began unless we agree otherwise in writing or a change is required by law.
These terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of its courts, without limiting any mandatory right to bring a claim elsewhere. If a provision is invalid or unenforceable, the remaining provisions continue to the extent they can operate independently.
Contact us and we'll be happy to talk through how these terms apply to your engagement.
